3.1. The Customer acknowledges that:
3.1.1. He shall ensure maintenance of complete confidentiality, secrecy and protection of the authentication parameters such as Mobile Phone Number, PIN, password/s and security answers allotted to him or any other mode of verification as may be stipulated at the discretion of MauBank .
3.1.2. He shall not disclose the Mobile Phone Number, PIN, password/s and security answers to any other person and shall not respond to any unauthorized SMS/ email/ phone call wherein such details have been asked for. MauBank shall, in no manner whatsoever, be held responsible or liable, if the customer incurs any loss as a result of the Mobile Phone Number, PIN, password/s and security answers or any other mode of verification as prescribed by MauBank from time to time being disclosed/ shared by the Customer with any unauthorized persons or in any other manner whereby the security of any of the modes of verification is compromised.
3.1.3. The Personal Identification Number (PIN) and Passwords issued by MauBank and allocated to the Customer/authorised user shall be kept secret and shall not be imparted or communicated to any person whomsoever. The customer shall exercise the same secrecy obligation in respect of the PIN/Password entered by the Customer/authorised user at his first or any successive log-in session.
3.1.4. He shall ensure that "remember my password" option is not enabled on his internet browser, Computer, or mobile device.
3.1.5. Security answers should be kept secret and should not be disclosed to anyone.
3.1.6. The token shall at all times remain the property of the Bank and the Customer shall not in any circumstances obtain any rights over, or in, the same.
3.1.7. The token provided to the customer/authorised user by the Bank should remain in the possession of the customer/authorised user at all times and should not be given to any person whomsoever.
3.1.8. The Bank must be notified immediately upon the customer becoming aware that his PIN/Password or security answers may have fallen into the hands of any unauthorised person, including a member of his family or made known to any person other than himself.
3.1.9. He shall nevertheless be liable to MauBank for any transaction effected through the use of his/any authorised user's PIN/Password by any person who acquired possession of it, with or without the Customer's/authorised user's consent, before a written notification in original is received by MauBank ; as if the Customer/authorised user had used it personally.
3.1.10. In case of dispute as to the effective time and date of notification that the PIN/Password and/or any equipment may have fallen into the hands of an unauthorised person, the time and date of receipt of the written notification by MauBank shall be conclusive.
3.1.11. He shall effect and maintain sufficient measures to protect and not part with possession of any of the equipment, and notify the Bank immediately on becoming aware of any unauthorised use or possession thereof, or of any claims by a third party in relation to the customer's use or possession thereof.
3.1.12. MauBank may accept as valid and duly authorised by the Customer, any instruction and/or message received by the Bank through the MauBank Internet Banking Service purporting to come from the Customer and authenticated in such manner as provided by MauBank . MauBank Internet Banking Service and this agreement shall be the authority for the Bank to act on any instruction and/or message so received.
3.2. Any data received by MauBank which has been authenticated by means of login/transaction password/s or Security Token within MauBank Internet Banking shall be duly relied upon by MauBank as being authenticated by the Customer registered with MauBank .
3.3. Any data received by the bank which has been authenticated by means of any MauBank Internet Banking service certification device, should be relied on by the bank as being authenticated by the holder of such device registered with the bank from time to time.
3.4. The Customer shall ensure that all data transmitted to or from the Bank through the MauBank Internet Banking Service is correct and shall advise the Bank immediately of any errors or discrepancies.
3.5. The Bank shall not be liable for any breakdown or failure of any equipment or medium of access to the bank's systems.
3.6. The customer shall ensure that he is entering the correct account number and transaction details when submitting transactions through Internet Banking Service.
3.7. The Bank shall be under no obligation to match the destination account number with the beneficiary's name involved in any payment/transfer instructions and in case of discrepancy, the destination account number shall prevail.
3.8. The Customer's instructions are irrevocable and unconditional and cannot be altered, modified, amended, restrained or extended by the Customer.
3.9. The Bank shall not be obliged to effect any payment in accordance with any instruction received by the Bank through its Internet Banking Service, unless:
3.9.1. Sufficient cleared funds are available on the account, from which the funds are requested to be paid, or:
3.9.2. Prior arrangements have been made with the Bank to overdraw the account and the limit allocated to the said account is not exceeded.
3.9.3. In the case where processing of instructions require running of batches by the Bank, sufficient cleared funds should be available on the debit account at the time of batch processing.
3.10. The Customer agrees that it is not, at all times, possible for the Bank to ensure that the payment to, or receipt of funds from, a third party financial institution can be made at any particular time or within any particular time limit.
3.11. If the Bank acts on any instruction received through the Bank's website or by email at ebanking@maubank.mu and thereby provides a banking service to the Customer which depending on the request, may require the submission of a signed instruction by the Customer/authorised user or other such authority, the Customer shall, by giving such instructions be deemed to be bound by the terms and conditions thereof.
3.12. If MauBank acts upon any instruction received via MauBank Internet Banking Service and thereby provides a banking service to the Customer which depending on the request, may require the submission of a signed instruction by the Customer/authorised user or other such authority, the Customer shall, by giving such instructions be deemed to be bound by the terms and conditions thereof.
3.13. The Bank may modify the MauBank Internet Banking Service from time to time and may, upon reasonable notice to the Customer, modify or substitute any of the equipment.
3.14. The Bank shall not be liable for any costs or expenses incurred by the Customer in the event of modification being made by the Bank.
